Cassation Court Overturns Acquittal of Fadeela Abdulrasoul, Her Husband and Brother-in-Law

Bahrain Mirror: The Cassation Court accepted on Monday (February 20, 2023) the Public Prosecution's appeal against the acquittal of citizen Fadeela Abdulrasoul, her husband Sayed Radhi Al-Alawi and his brother Sayed Jaafar Al-Alawi, and ordered their retrial in a politicized case.

On Wednesday, October 5, 2022, the Court of Appeals acquitted the family members of prisoner of conscience Mahmoud Al-Alawi, his two uncles Jaafar and Radhi and his wife Fadeela of a charge over which they were imprisoned for more than 3 months, which is "covering up" their detained nephew, Sayed Mahmoud Al-Alawi, who suffers mental health disorder. The authorities claimed that he escaped from a psychiatric hospital where he was detained for serious mental illness as a result of torture and deliberate health negligence.

Several courts have repeatedly rejected lawyers' request to release the three detainees on the guarantee of their place of residence, and have also repeatedly postponed their trials until they acquitted them in October 2022. 

On February 14, 2022, the regime summoned Fadeela Abdulrasoul after arresting her husband and brother-in-law on the same charge, and detained them for a week pending investigation. On February 21, 2022, the Public Prosecution decided to extend the detention of the three for two weeks and later released them. The authorities then arrested the 3 citizens at the dawn of June 19, 2022 in a house raid on the grounds of prison sentences issued against them over the same charge.

It is to mention that the cassation court had sentenced Sayed Mahmoud Al-Alawi to 3 years in jail and added another 15 years over the charge of "escaping" the hospital, before the appeals court acquitted the family of this case.
